Terms & Conditions for guests
The following terms and conditions apply to all bookings of holiday accommodation. They become part of the rental agreement for the booked accommodation and, in addition to the statutory provisions, regulate the contractual relationship between the contracting parties guest (you) and owner.
For bookings of accommodation via third parties on the Internet, the general terms and conditions of the respective provider apply differently.
Contract
Home2Escape brokers the holiday accommodations offered via this website exclusively on behalf of and for the account of the respective owners. A rental agreement is concluded exclusively between the guest (you) and the owner of the accommodation. Home2Escape only acts as an agent of a rental agreement, but not as a tour operator within the meaning of §§ 651a et seq. of the German Civil Code (BGB).
The rental agreement becomes legally binding with the payment of the rental price at the end of the booking process, the contract is considered to have been concluded.
With the booking, you as a guest commit yourself to a legally binding obligation to accept the holiday accommodation in the specified rental period and at the same time confirm that you have read and agreed to these terms and conditions.
Liability
You act as a guest in your own name and on behalf of all fellow travelers. You are therefore also liable for all fellow passengers.
The descriptions and pictures of the accommodation are based on the information provided by the respective owners. No guarantee is assumed for the equipment, size and nature of the accommodation; Errors are reserved.
Changes to the contract require written confirmation by Home2Escape in order for them to take effect.
You agree to the disclosure of the required data - also with regard to other accompanying persons - e.g. for invoicing to us and by us to the extent necessary. All regulations on Privacy apply.
Payment agreements
Home2Escape is commissioned with the processing and collection of the rental price.
The rental price is to be paid in full online with PayPal at the end of the booking process. The following cancellation and withdrawal conditions apply as agreed.
Cancellation and withdrawal
The cancellation and withdrawal conditions apply to the regulation from the contract.
We generally understand a withdrawal or cancellation. It is recommended that every guest take out travel cancellation insurance.
You can withdraw from the rental agreement or cancel it in writing at any time before the start of the rental without giving reasons. In this case, we charge a cancellation fee of 25 euros plus
more than 8 weeks before the start of the rental period: 30 % of the total rent
up to 5 weeks before the start of the rental period: 50% of the total rent
up to 3 weeks before the start of the rental period: 80% of the total rent
thereafter and in case of no-show, 100% of the rental price without additional cancellation fee.
The receipt of the notice of termination by us is decisive.
Home2Escape will try to rent the holiday accommodation elsewhere. There is no fundamental obligation to look for a replacement tenant in this case. We will, however, offset any advantages that the owner obtains from such a rental elsewhere against the compensation.
Use of the accommodation
The use of the apartment is limited to the number of people indicated on the website.
Subletting or subletting as well as transfer of use to third parties is not permitted.
Duty of care / damages / house rules
No one intentionally damages things, but it can happen to anyone. In this case, we ask you to report the damage to the owner immediately so that the owner can obtain appropriate replacement. In principle, you are obliged to reimburse the damage.
The apartment is rented with full inventory. Any shortages, defects or damage must be reported to the owner immediately. Any complaints about the condition of the apartment and the inventory will be accepted only one day after arrival. The inventory must be handled gently and with care.
You are liable - also for the fault of your fellow passengers - for all damages caused by culpable violation of your duty of care and disclosure, especially in the event of improper handling of technical equipment and other furnishings or loss of keys. Damage caused by force majeure is excluded from this.
You will give the owner a reasonable amount of time to examine the complaint and remedy the defect or damage. He can make use of third parties for this purpose. You agree to change your holiday accommodation if necessary if the disruption is unreasonable. You further accept that we can only afford a reduction in the rental price after consultation with the owner. Defective electrical appliances will be repaired or, if necessary, replaced as quickly as possible and do not entitle you to compensation. For this purpose, the owner may enter the accommodation even in your absence as an exception, if an attempted appointment fails or further/higher damage is to be expected due to the non-remedy.
Waste, harmful liquids, food scraps and the like must not be disposed of in the toilet, sink or sink. Garbage may only be disposed of in the respective collection containers.
The accommodation is not rented as a "smoking accommodation". Please take advantage of the many possibilities outside closed rooms.
In addition, you acknowledge the rights and obligations of the respective house rules of the holiday accommodation, which can be specified on site by regulations of the owner (e.g. for the use of air conditioning units).
Pets
Pets are only allowed in the holiday accommodations, which have their own processing step in the booking process for specifying a pet.
Pets may not be left in the holiday accommodation without qualified supervision. You must ensure that the pet does not use or damage the furniture and furnishings. In particular, pets are not allowed to lie on the couch or in beds. The guest is liable for all damages and additional expenses that are not in accordance with the contract and result from keeping animals.
Internet
Internet/Wi-Fi is usually provided in the holiday accommodations. The possibility of use depends on the provider.
You are responsible for the data transmitted via the Internet/WLAN, the fee-based services used and the legal transactions carried out. In addition, as for your own actions, you are also liable for the use of the Internet by other persons (fellow passengers/children/guests) to whom you grant access to the Internet.
If you visit fee-based websites or enter into liabilities, the resulting costs are to be borne by them. You are obliged to comply with applicable law when using the Internet/WLAN. In particular, you do not use the Internet/WLAN to retrieve or distribute immoral or illegal content; do not reproduce or distribute any copyrighted goods and observe the applicable youth protection regulations.
They indemnify the owner against all damages and claims of third parties that are based on an unlawful use of the Internet/WLAN by him against this agreement. If you recognize or must recognize that such a violation exists or is imminent, he will inform the owner immediately, if necessary via Home2Escape.
Arrival and departure
The booked accommodation will be available to you from 3 p.m. on the day of arrival after cleaning has been completed. However, in the event of a large number of guests, delays may occur that do not justify a claim for compensation. On the day of departure, the accommodation must be vacated by 10:00 a.m. at the latest.
As a guest, you must treat the apartment/house and the furnishings with care and keep them clean during the rental period. At the end of the rental period, the accommodation must be left in perfect condition. (The accommodation is to be left swept clean, the dishes are to be washed in the cupboards/drawers and the garbage is to be disposed of).
Other Agreements
The owner's liability for property damage and personal injury is excluded, unless it is based on an intentional or grossly negligent breach of duty or on a negligent breach of essential contractual obligations (so-called cardinal obligations) of the owner.
The owner accepts no liability for loss or theft of cloakroom or other property and possessions of the guests.
Formal requirements
For ancillary agreements, amendments and additions to the contract as well as all legal declarations, the text form generally applies in accordance with § 309 No. 13 BGB, unless the written form is provided for by law or these GTC regulate otherwise.
Severability clause
If a contractual provision is invalid, this does not affect the validity of the remaining provisions. Rather, instead of any invalid provision, a substitute provision that corresponds to the purpose of the agreement or at least comes close to it applies, as the parties would have agreed to achieve the same economic result if they had known that the provision was invalid. The same applies to gaps.
Choice of law and jurisdiction
For all disputes arising from the contracts, the place of jurisdiction is Darmstadt. German law applies. However, Home2Escape is not a contractual partner in the rental agreement between guest and owner.
